1. Acceptance
By creating an account or using StarviewMenu ("Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service. These Terms form a binding agreement between you and Starview Data LLC ("Company," "we," "us," "our").
2. What StarviewMenu Does
StarviewMenu is a software-as-a-service platform that lets food vendors, food trucks, restaurants, and market operators publish digital menus accessible via QR code or direct URL. We provide tools to users to manage their menu content, display analytics, and share business information with their customers.
3. Account Registration
Accounts are created by signing in with a Google account. You confirm that the information you provide is accurate and that you are at least 18 years old. You are responsible for all activity that occurs under your account, so keep your login secure.
4. Subscription Plans
We offer the following plans:
- Free: Core menu publishing features at no charge, subject to the inactivity policy described in Section 9.
- Pro: Enhanced features for $9/month, billed monthly via Stripe. Full plan details are shown at the time of upgrade.
We reserve the right to change plan pricing with 30 days' advance notice to existing subscribers.
5. Payment and Billing
Paid subscriptions are processed by Stripe, Inc. By subscribing, you authorize us to charge your payment method on a recurring monthly basis. You agree to Stripe's services agreement. All charges are in USD. Please see our Refund Policy for details on when refunds apply.
6. Cancellation
You may cancel your Pro subscription at any time from your account settings — no phone call or email required. Cancellation takes effect at the end of the current billing period, and you keep Pro access until then. After cancellation, your account reverts to the Free tier.
7. Your Content
You retain full ownership of all menu content, images, and business information you upload ("Your Content"). You grant us a limited license to store, display, and transmit Your Content solely as needed to operate the Service. You are responsible for ensuring Your Content does not violate any applicable law or third-party rights.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulation;
- Upload content that is defamatory, obscene, or that infringes on someone else's intellectual property;
- Attempt to gain unauthorized access to any part of the Service or its infrastructure;
- Reverse engineer, scrape, or create derivative works based on the Service.
9. Data Retention and Inactivity
To keep the platform healthy, Free accounts that go dormant are eventually removed. Here is exactly how it works:
- 30 days of inactivity (no menu views and no account login): your menu is archived and hidden from the public.
- 60 additional days while archived (90 days total): your menu and all associated data — items, photos, and analytics — are permanently deleted.
Pro subscribers are fully exempt from archiving and deletion for as long as a paid subscription is active. Before your menu is archived, we will send a warning email to the address on your account. You can reactivate at any time by logging back in before the 60-day deletion window closes.
10. Termination
We may suspend or terminate your account if you violate these Terms or engage in conduct harmful to the Service or other users. You can delete your own account at any time by contacting us at support@starviewdata.com; all associated data will be removed within 30 days of your request.
11. Intellectual Property
The Service — including its software, design, and trademarks — is owned by Starview Data LLC. These Terms do not transfer any ownership of the Service or our intellectual property to you.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STARVIEW DATA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. IN ALL CASES, OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL AMOUNTS YOU PAID US IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE CLAIM.
14. Governing Law
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-law rules. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Connecticut, and you consent to personal jurisdiction there.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and with a prominent notice in your dashboard at least 14 days before the changes take effect. Continuing to use the Service after that date means you accept the updated Terms.
